DMCA & Copyright Policy

FoilNexus LLC ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects users of eFoilCrew to do the same. This policy describes how we respond to claims of copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and applicable international copyright laws.
1. Designated Agent

2. Filing a DMCA Takedown Notice
If you believe that content on eFoilCrew infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:
- A physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered, a representative list);
- Identification of the material that is claimed to be infringing, with sufficient detail for us to locate it on the Service (e.g., URL or screenshot);
- Your contact information, including name, address, telephone number, and email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorised to act on behalf of the owner.
Send your notice to dmca@foilnexus.com. We will review and respond to valid notices promptly, typically within 5 business days.
3. Counter-Notification
If you believe your content was removed in error or is not infringing, you may file a counter-notification. Your counter-notice must include:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed;
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the district where your address is located (or, if outside the US, any judicial district in which FoilNexus LLC may be found), and that you will accept service of process from the party who filed the original notice.
Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we will restore the removed content.
4. Repeat Infringers
In accordance with the DMCA and other applicable laws, we will terminate the accounts of users who are repeat copyright infringers. We consider a "repeat infringer" to be any user who has been the subject of more than two valid DMCA takedown notices. We may also terminate accounts after a single instance of willful or egregious infringement.
5. User Content & Copyright
When you upload photos, posts, or other content to eFoilCrew, you retain ownership of your work. However, by posting content, you grant us the license described in our Terms of Service (Section 4.2).
Please ensure that you have the right to share any content you upload. This includes: photos you took yourself or have permission to use; text you wrote yourself; and session data from your own activities. Do not upload content that belongs to others without their express permission.
6. International Copyright
While this policy follows the DMCA framework, we respect copyright laws internationally. If you are located outside the United States, you may still report copyright infringement using the process above. We will evaluate your claim under applicable law and take appropriate action.
7. Good Faith & Misrepresentation
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and legal fees. Do not file a DMCA notice or counter-notice unless you have a good-faith belief in its accuracy.
