This Disclaimer forms part of our Terms of Service. By using eFoilCrew, you acknowledge and agree to the following.
1. Inherent Risks of Water Sports
Electric hydrofoiling (eFoiling), surfing, wing foiling, and other water sports involve inherent and significant risks, including but not limited to:
- Drowning or near-drowning;
- Collisions with underwater obstacles, marine life, or other watercraft;
- Cuts, lacerations, and impact injuries from hydrofoil components;
- Electrical hazards from motorised equipment;
- Hypothermia, heat exhaustion, and sun exposure;
- Equipment malfunction or failure;
- Changing weather, water, and environmental conditions;
- Injury or death.
BY USING THIS SERVICE, YOU ACKNOWLEDGE THAT YOU UNDERSTAND THESE RISKS AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH YOUR PARTICIPATION IN EFOILING AND OTHER WATER SPORTS, WHETHER OR NOT DESCRIBED ABOVE.
2. Not Safety Guidance
eFoilCrew is a tracking, analytics, and community platform. It is not a substitute for professional instruction, safety training, or proper equipment maintenance. We do not provide: riding instruction or lessons; safety certifications; equipment inspection or maintenance advice; weather forecasting for safety-critical decisions; emergency or rescue services; or medical advice.
Always wear appropriate safety equipment, obtain proper training from qualified instructors, check local regulations, and exercise personal judgement before entering the water.
3. GPS, Speed & Data Accuracy
Session data displayed on the Service — including GPS tracks, speed measurements, distance calculations, elevation data, foil percentages, and run counts — is derived from consumer-grade GPS devices (primarily Garmin wearables) and processed by our algorithms. This data may contain significant inaccuracies due to GPS signal quality, device limitations, environmental interference, or processing errors. Do not rely on this data for navigation, safety decisions, competition adjudication, or any purpose where accuracy is critical.
4. Map & Location Data
Maps, spot locations, and geocoded addresses are provided by Mapbox and other third-party services for informational purposes only. They may not reflect current conditions, access restrictions, navigation hazards, or regulatory boundaries. Always verify local access rights, marine regulations, and water conditions independently before visiting any spot shown on the platform.
5. Weather Information
Weather data and condition reports shown on the Service are sourced from OpenWeatherMap and user-submitted spot reports. This information may be inaccurate, outdated, or incomplete. Never rely solely on weather information from the Service for safety-critical decisions. Always check authoritative weather sources and use your own judgement before going on the water.
6. User-Generated Content
Spot condition reports, forum posts, comments, and other user-generated content represent the opinions and experiences of individual users. We do not verify, endorse, or guarantee the accuracy of user-submitted information. Riders should exercise independent judgement and not rely solely on community reports when making decisions about where, when, or how to ride.
7. Gear & Equipment Information
The gear catalog, product specifications, compatibility information, and setup configurations on the Service are provided for informational and community purposes only. We do not manufacture, sell, inspect, or certify any equipment. Product listings do not constitute endorsements. Always follow manufacturer guidelines and consult qualified professionals for equipment selection and maintenance.
8. Leaderboards & Performance Data
Rankings, leaderboards, badges, and achievement metrics are based on self-reported or automatically imported session data that may be inaccurate. They are provided for community engagement and personal tracking only — not as authoritative performance measurements. Do not use leaderboard standings to push beyond your skill level or take unsafe risks.
9. Third-Party Services & Links
The Service integrates with and may contain links to third-party services (Garmin Connect, Mapbox, and others). We are not responsible for the content, accuracy, privacy practices, or availability of any third-party service. Your use of third-party services is governed by their respective terms and policies.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOILNEXUS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, DEATH, OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO: (A) YOUR PARTICIPATION IN EFOILING OR OTHER WATER SPORTS; (B) YOUR RELIANCE ON ANY DATA, INFORMATION, OR CONTENT PROVIDED THROUGH THE SERVICE; (C) INACCURACIES IN GPS, SPEED, WEATHER, MAP, OR OTHER DATA; (D) DECISIONS YOU MAKE BASED ON SPOT CONDITIONS, USER REPORTS, OR OTHER COMMUNITY CONTENT; OR (E) ANY EQUIPMENT MALFUNCTION, FAILURE, OR MISUSE.
11. Release & Waiver
BY USING THE SERVICE, YOU RELEASE AND FOREVER DISCHARGE FOILNEXUS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, AND LIABILITIES OF ANY KIND ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN EFOILING OR OTHER WATER SPORTS, WHETHER CAUSED BY THE NEGLIGENCE OF FOILNEXUS LLC OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
Some jurisdictions do not allow the exclusion or limitation of certain damages or the release of liability for negligence. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
12. Acknowledgement
By creating an account and using the Service, you acknowledge that you have read, understood, and agree to this Disclaimer and Assumption of Risk. If you do not agree, do not use the Service.
